Guardianship

Guardianship is a legal intervention put in place when a person unable to make life’s big decisions. Our participants have been diagnosed with an intellectual and/or developmental disability and the court has deemed these individuals as incompetent*, basically unable to take care of themselves in all aspects of their life. In these situations, a Guardian will provide them with support and make decisions on their behalf. Parents or other family members commonly serve as Guardians. In cases where this is not possible, families can choose to make arrangements for The Arc of the Triangle, dba Triangle Disability & Autism Services, to serve as corporate guardian.

Triangle Disability & Autism Services has been providing quality services and programs to the disability community for over 60 years. We provide Medicaid and other state-funded services to individuals that support them in the community and in their home. We have a robust Supported Employment program and several great community programs.

Guardianship Services allows the guardianship specialist the authority to make day-to-day decisions of a personal nature, except financial decisions, on behalf of the individual. Such decisions would include making arrangements for food, clothing, living arrangements, medical care, recreation and education.

The four areas of Guardian on the Person are: Medical, Habilitative, Residential, and Social.

Guardianship PLUS

Guardianship PLUS adds more services and benefits for the individual for an additional cost and can be added a la carte.

  • quarterly reporting (email or mail) to designated family members/natural supports
  • extra monthly home/community-based visit with participant
  • semi-annual meetings with natural support team (to be determined by family) to ensure needs are being met
  • custom needs can be designed as the law allows

  • Meet with your legal counsel to begin necessary steps to appoint The Arc as corporate guardian.

As Guardian of the Person**, our Guardianship Specialist will be an advocate for all of our Guardianship participants (legally referred to as “Ward”), just as we are with our other services. Our goal is to keep our participants secure, safe, and living as independently as they can. Triangle Disability & Autism Services employs a Person-Centered approach to all service delivery. It is our goal to partner with the participant and allow them to be a part of their life choices and decisions whenever they can. Triangle Disability & Autism Services is committed to the safety and well-being of the participant they are supporting in all of the decisions that we will make.

In times of critical decision making, Triangle Disability & Autism Services will convene a Peer Review Committee made up of professionals to help achieve the best result for the participant. This may include medical decisions, end-of-life decisions, housing changes, and human rights concerns.

*”Incompetent is a legal term that will not be used by Triangle Disability & Autism Services outside of court communication and paperwork.
